Terms of Service

Last updated: September 20, 2026

1. Agreement to these terms

By using this website or sending us a request through it, you agree to these terms. If you don't agree, please don't use the site or send a request. Texas law governs these terms and your use of this site.

If you hire us, your signed proposal controls the work. If your proposal and these terms say different things, the proposal wins. These terms cover anything the proposal doesn't.

2. Services and our right to decline work

We provide concrete flooring services in Austin, TX, and the nearby towns we've confirmed we cover, including:

  • Mechanical polished concrete (grinding, honing, polishing, and hardening the surface)
  • Residential polished concrete for remodels and new construction
  • Commercial polished concrete for retail, office, and warehouse spaces
  • Epoxy floor coating systems over prepared concrete
  • Concrete overlays and resurfacing, including polishable overlays

Whether we can offer a given system depends on your slab's condition, how the space will be used, and whether our assessment shows it's a good fit.

We may turn down any project or request for any lawful reason. Sending a request, talking with us, or getting an estimate doesn't create a contract. We have no duty to do any work until we both sign a written proposal.

3. Information on this website

Our guides, service pages, tools, and other content here are general information written to help you make a decision. They aren't a plan for your particular floor, and they don't replace an assessment at your site. Concrete varies, and results depend on your own slab. If you suspect a structural problem, have a qualified structural professional look at it before any finishing work.

Nothing on this website is an offer, a promise, or a contract. The actual scope, pricing, and terms of any project are set only by a written proposal or agreement that you and we sign. Please don't rely on anything on this site as a promise about your project. We may change or remove anything on this website at any time, without notice.

4. Quotes, estimates, change orders, and payment

We quote prices in US dollars, per project, after we look at the floor. We don't publish flat rates per square foot, because prep, repairs, edge work, access, the finish you pick, treatments, and phasing all change the scope. Your signed proposal spells out what's included, and anything it doesn't list isn't included. Any price we give before you sign is an estimate, not a binding offer.

Some conditions only show up once work starts, such as moisture, old adhesives, coatings, soft concrete, or hidden damage. When we find one, we'll stop work in that area and talk it through with you. Changes to the scope or price go in a written change order. We may pause the affected work until you approve it.

Deposits, payment amounts, and due dates are set in your signed proposal. Late payments may carry the interest and fees your proposal lists, as far as the law allows. If we have to take steps to collect money you owe, you agree to pay our reasonable collection costs and attorney's fees, as far as the law allows.

We keep every right the law gives contractors to get paid, including lien rights under Chapter 53 of the Texas Property Code. When the law requires notices or disclosures for your kind of project, we include them in your proposal or deliver them the way the law requires.

5. Scheduling, delays, and cancellation

We set the schedule with you, and any start or finish dates we give are estimates. We aren't responsible for delays caused by things outside our control. Those include weather, material shortages, site conditions, site access, permits, unfinished prep by others, and other trades running late. When a delay like that happens, the schedule moves by a reasonable amount.

If the law gives you a right to cancel, you can use it without any charge from us. For example, a contract you sign at your home may come with a three day right to cancel. When that right applies, your proposal includes the cancellation notice the law requires.

Outside any legal right to cancel, please give us at least 24 hours' notice to cancel or reschedule a work day, so we can send the crew elsewhere. A late cancellation, or canceling a signed project, may come with the charges your proposal lists. Those can include materials ordered for your job and costs we've already paid to get the crew and equipment ready.

6. Site conditions and what we need from you

  • Clear access to the work area, including moving furniture, fixtures, and appliances out unless we agree otherwise
  • Power and water set up the way we ask for our equipment
  • Telling us about known slab issues, past coatings, and repairs
  • Telling us about pipes, wiring, radiant heat, post tension cables, or anything else in or under the slab. We aren't responsible for damage to items in or under the slab that you didn't point out or that weren't marked.
  • Getting any permits and HOA, landlord, or building approvals the project needs, unless your proposal says we'll handle them
  • Keeping people and pets out of the active work zone. Anyone with breathing problems should stay away from the area while we grind.
  • Moving or covering belongings, electronics, and stock near the work area, unless your proposal says we'll do it. Some fine dust can get past barriers and extraction, and cleanup beyond the work area isn't included unless your proposal says so.
  • Protecting the finished floor from other trades after handover, where that applies
  • Taking care of the floor after we finish, including cleaning, cure times, and how it's used. We walk you through these in person when the job is done.

Grinding and polishing work right up to the walls, so baseboards, paint, and trim near the floor can get scuffed. Touch up of those areas isn't included unless your proposal says so.

Some older adhesives and floor coverings can contain asbestos or lead. If we find material we suspect may be hazardous, we'll stop work in that area. Testing and removal are your responsibility unless your proposal says otherwise.

7. Results and expectations

Polished concrete is made from natural materials and finished by machine. Color shifts, uneven stone spread, changes in sheen, visible repairs, trowel marks from the pour, and cracks, old or new, are normal in concrete, not flaws in our work. When the job calls for it, we may use a sample or test area to talk through the look before we start. A sample shows the general look, and the full floor can still differ from it. We don't claim any floor is stain proof, slip proof, maintenance free, or crack free. Traction depends on the finish, what's on the floor, and water. We also don't guarantee that the finished floor will match a photo, a sample, or another floor.

8. Final walkthrough and raising concerns

When the work is done, we walk the floor with you. Please point out anything that concerns you during the walkthrough, or tell us in writing within 7 days after we finish. Once furniture goes back, the floor is in use, or other trades have worked on it, it gets hard to tell what caused a problem. As far as the law allows, a visible issue you don't raise in that time is treated as accepted.

We're also available after the job if questions come up later. Just call or email us.

9. Warranty terms

Warranty terms, if any, vary from project to project. They depend on the materials, the slab, and your needs, and we discuss them during the consultation. Not every project comes with a warranty. The only warranty terms that apply are the ones written in your signed scope or proposal, including what they cover and exclude. Unless your signed scope says otherwise, a warranty doesn't cover damage from misuse, the wrong cleaning products, impact, structural movement, moisture from the slab, or work done by others. Where a manufacturer offers a warranty on a product we use, that warranty comes from the manufacturer under its own terms.

Any written warranty in your signed proposal takes the place of all other warranties, spoken or implied, as far as the law allows. Texas law doesn't let some implied warranties be waived, such as the warranty that repair work is done in a good and workmanlike manner. Where one of those applies, we measure our work against the materials, methods, and specifications in your signed proposal.

If covered work doesn't meet your signed terms, we'll repair or redo the affected area. At our choice, we may refund what you paid for that area instead. As far as the law allows, that's the only remedy under a warranty.

10. Limitation of liability

As far as the law allows, Austin Polished Concrete Floors is not liable for indirect, incidental, special, consequential, or punitive damages. That includes lost income, lost use of the space, and the cost of moving out or storing belongings. It covers damages from using this website or our services.

As far as the law allows, our total liability for a project won't be more than what you paid us for the part of the work in dispute. For use of this website alone, with no signed project, our total liability is limited to $100. Nothing in these terms limits any liability the law says can't be limited.

11. Notice and a chance to make it right

If you think something is wrong with our work, please tell us in writing first and give us a fair chance to look at it and fix it. Most concerns get settled that way.

For claims about residential construction work, Chapter 27 of the Texas Property Code requires written notice by certified mail, return receipt requested, at least 60 days before a lawsuit. The law also gives us the right to inspect the work and make a written offer to repair it or pay for it.

Claims under the Texas Deceptive Trade Practices Act need written notice at least 60 days before a lawsuit, as Section 17.505 of the Texas Business and Commerce Code requires. Your proposal may include other notices the law requires for your project.

Before either of us files a lawsuit, we both agree to try mediation in Travis County, with the cost split evenly. Any lawsuit must be filed in a court in Travis County, Texas, unless the law requires a different county. If your signed proposal has its own dispute terms, those terms control.

12. Calls, texts, and emails

When you send us a request, you agree that we may call, email, or text you at the number or email you gave us. We'll contact you about your request, a site visit, your project, and questions afterward. Message and data rates may apply. To stop texts, reply STOP or tell us by phone or email. We don't send marketing texts without your separate permission.

13. Photos of our work

We may take photos of our work at your property before, during, and after the job for our records. We ask your permission before we publish photos of your property, say where your project is, or quote you.

14. Using this website

Please don't misuse this site. That includes copying it in bulk, sending spam or false requests through our forms, trying to break into it, or uploading anything harmful. If your misuse of this site leads to a claim against us, you agree to cover our reasonable costs and losses from it, as far as the law allows.

The site and its tools are provided as is. We don't promise the site will always be available, free of errors, or up to date. Tool results, such as area and material estimates, are rough figures for planning only.

15. Intellectual property

The text, guides, layout, graphics, and our own photos on this site belong to Austin Polished Concrete Floors and are protected by copyright. You're welcome to share links, but please don't republish the content as your own.

16. Links and outside services

We link to industry groups and standards documents when they help explain a technical point. We don't control those sites and aren't responsible for what's on them.

Our forms run through FormSubmit, an outside form service with its own terms and privacy policy. As far as the law allows, we aren't responsible for outages, errors, or data handling by outside services. See our Privacy Policy for how we handle your information.

17. General terms

  • If a court finds part of these terms can't be enforced, that part is limited only as much as needed, and the rest still applies.
  • If we don't enforce a term right away, we haven't given it up.
  • Your signed proposal, any signed change orders, and these terms are the full agreement for your project. Spoken comments, website content, and earlier estimates aren't part of it unless the proposal includes them.
  • The sections on payment, warranty, liability, and disputes still apply after a project ends.

18. Changes to these terms

We may update these terms at any time, and changes take effect when we post them here. Changes don't alter a proposal you've already signed. The date at the top shows the latest update.

19. Disclaimer

  • We don't guarantee any specific result, look, color, sheen, or lifespan for a floor.
  • Estimates and quotes aren't binding until we both sign a written proposal.
  • Timelines are estimates. Weather, material availability, and site conditions can change them.
  • Grinding makes dust. How we control it varies by job, and we don't claim any job is dust free.
  • We aren't responsible for conditions that were already there or hidden before work began, such as moisture, old coatings, contamination, slab movement, or cracks under flooring.
  • Concrete varies naturally in color, stone, and sheen, and it can crack. These aren't defects in our work.
  • After we finish, you're responsible for how the floor is cared for and used.
  • Some photos on this site are example work. They show the kinds of finishes we do, not a specific customer's project, and they aren't a promise of how your floor will look.
  • Warranty terms, if any, vary by project. We discuss them during the consultation, and only what's written in your signed scope or proposal applies.

Every project starts with an on-site evaluation. Actual scope, pricing, and expected results depend on your specific substrate condition, environment, and project requirements. The website describes our services in general terms. Your signed proposal governs the actual work.
